Accused murderer wants day in court

Murder-accused Desmond Alphonso, in jail since 2006, said he is tired of having his trial pushed back.

“I am tired of my trial being pushed back all the time and it seems like this judge wants to push it back until the next assizes. I have been in jail since 2006,” Alphonso told BVI News as he was escorted back to jail following an appearance in court this morning.

Alphonso’s defense team was prepared for a February 15 trial date, but may have to wait as the presiding judge may not be available for part of the week of February 22, 2010.

On Friday the defense team will learn whether the trial will commence and then break while the judge is away.

Alphonso is charged with the murder of Christopher Bailey who was suspected  in the death of Jamaican Dorcas Rhule. Bailey, a Jamaican, died from stab wounds on December 6, 2006, 12 days after being found along Paraquita public road. He had identified Alphonso as his assailant.

Tana-ania Davis-Small is representing Alphonso.

The man deserves his day in court just like anyone else. Justice delayed is justice denied ~ and four years is quite a long delay, by anyone’s standards!

The police have Christopher Bailey’s statement, naming DA as the man who stabbed him. A dying man’s testimony is pretty conclusive evidence and will be very, very difficult to disprove. ... he was mixed up in this whole mess somehow. The extent to which DA was involved or if he was involved in the Bobby’s robbery and/or the murder of Dorcas Rhule, may never come to light. But that’s what trials are for. Let’s find the truth!

I will not judge a man before he has had a fair trial and proven guilty beyond any reasonable doubt. Hopefully, the truth will be uncovered during his trial. So ... we can’t just proclaim that he is guilty of murder before he has had his day in court. So let’s get on with the trial and put the matters of Dorcas Rhule and Christopher Bailey to rest once and for all!

Luv Angel I shall respond to you this once, only because you need help and obviously clarification.Unless you were at the crime scene and saw what happened then you are just in saying this young man is guilty. You were not there, therefore your comments only prove that you are being hateful and ignorant. You have a right to your own opinion but when your opinion is based on heresay and a personal hatred which is very obvious in your case then you should keep them to yourself. The message I was trying to convey that only spurred more hatred from you is as follows. He deserves his day in court because he wants to prove to the courts that he is innocent. Until the court deems otherwise, he is an innocent man. If he is proven guilty, then one can say he is guilty. When you wish bad things for others it will come around and those bad things will fall on your shoulders. Remember what I say, for I speak the truth. God bless

First if my family was in a situation like that, thats their business. We all can come on here and pretend like we know wnot what he did, STRUPES. And are you kidding me, telling me he's someone son and brother and all that BS? What about the man he killed in cold blood? Wasn't he someone's brother, son and family member? Life is a double edge sword, so stop making excuse for some and ready to hang the others.....

IF ANY OF MY FAMILY MEMBER KILL SOMEBODY AND I KNOW, I WILL MAKE SURE YOUR ..GET WHAT YOU DESERVE. LIFE IS LIFE, STOP PUTTING OTHERS ABOVE OTHERS, FULL STOP.

I agree with Ray. No one deserve to sit in jail for all those years without a trial. I am not a member of his family. He is a son and a brother, he has a family. I hope none of your relatives or friends end up in his situation.

DENNIS WORRYING ABOUT THE PUSH BACK DATES LIKE THAT IS GOING TO MAKE THE MURDER CASE ANY BETTER.BOY SHUT YOU MOUTH AND STAY YOU A-- IN PRISON ...... NOW YOU CRYING .THEY SHOULD RELEASE THE OTHER BOYS AND GIVE YOU ALL THE LIFE SENTENCE. IMAGINE YOU HAVE ALL THEESE MONEY AND STILL COULDNT SATISFY YOU IS A BARE FACE CRIMINAL.

Sometimes before the case comes on some of the witnesses are missing and no conviction. We watching to see how long them going to wait to try that ..man from up the east who allegedly had indecent behaviour with the gul under the age of 13. We watching. His day should be coming up soon, I hope

Innocent until proven guilty. The man wants his time to prove he is innocent. A person is innocent uless they confess to the crime in question or they are found guilty in the court of law. Posting nasty comments about someone you don't know just shows that you are lacking in life and usually your hatred of others turns around on you in ways unexpected so stop the hating and start wishing everyone well.

...When people stop going to school, gaining expertise and never returning home to work in the territory (individualistic mentalities as opposed to collective thinking)... When citizens learn how to be advocates for themselves and rise up in civilized protests... When complaints are publicly written and publisized. I could go on and on. Change is our responsibility my friend. It does not just happen by us venting on BVInews, or to our spouses over dinner at night.

It is not just in the BVI that there are all these delays - its a "Lawyers Game". Now that i have said that i do hope that this heartless animal is loceked away for good real soon. We dont need this man on our streets at all, he was a menace when he was allowed to be on the streets - let him stay up there with his friends.

I hope they make you wait and wait some more then after you wait some more, give you your time in court and them give you some good years in prison. You have done a lot of mess ...so I don't see why you should be on the street again.

This is a serious problem in the B.V.I, and needs urgent redress. Cases should not have to take years to come to court, and a defendant should not have to languish in jail year after year until their case is finally heard. All this delay does is potentially compromise the case and thwart justice. This is outrageous. I have said this before and I'll repeat again: Justice delayed is justice denied, and that goes both ways. Whether or not one feels a person is guilty or innocent, they deserve a speedy trial. When are we every going to start doing things right in the B.V.I.? When?
